Terms & Condition

A. Acceptance include terms and condition mentioned below and also includes shipping policy, Copyright policy & Privacy Policy. 

1.Seller means and include bluecor.in. Buyer means and includes entity/person/company etc. who intends to purchase.

2.By checking/clicking on checkbox it is understood that you have read out terms and condition while ordering product from our website and are abiding by the terms and conditions. Unboxing video is mandatory, absence of which, claims related to product return and delivery related queries will not be entertained/ taken into consideration. Absence of Unboxing video itself confirm that product is delivered securely and you have no objection related to quality of the product. No otherwise queries will be entertained related to damaged/ Defect or any other issues with the order. Read the unboxing video guidelines carefully on the shipping policy page while purchasing/ordering from seller’s website. 

3.Intended age for the products listed on the individual product page, Most of the products are intended for 14+ age group until mentioned otherwise. By accepting terms and conditions / checking the checkbox, you accept that you are of the age of 14 years or above.

4. By checking/clicking on checkbox it is confirmed that you have read the product description carefully and you accept the condition, size and other details mentioned in the product description page.

    B.  Acceptance of order

    1.Acceptance includes confirmation page. When a purchase order is placed on seller’s website, there appears an order confirmation page and an email directed to the buyer’s personal email account stating their Products order details/ status. This condition does not form the contract of sale till the consideration (i.e.) “Money/Payment” is not received to the seller. Once the payment is received, the seller will process the request and will dispatch the product through the available courier services.

    2.The seller reserves the right to cancel any order without any explanation. Refund if any will be reverted through the wire mode of transfer within 8-15 bank working days after cancellation. However, any threats or defamatory statements made through any communication method, social media, forums, public platforms, or public communication groups will be considered acts of defamation, and they will result in legal action.


      C.  Prices

      1.Prices means actual Price/MRP which are shown on the product description page and is the final price of the product including other applicable taxes and shipping charges. Unless mentioned otherwise.

      2.Price more than MRP means additional charges (difference amount from MRP to selling price) for shipping and packaging charges. Pre-ordered prices may differ subject to availability of the product and may change after landing of the product. Seller will intimate the same via email to the buyer who opted for pre-ordered product that there are any changes in price/MRP after buyer have ordered it as pre-ordered product.

      3.Product which are not tagged as "Sold Out" “test product” and still has "0" Price on listing can be a test product or listing error. You are required not to make order of such products with such listings. If such order is received to seller, it will be cancelled by default and no such claims will be entertained on such orders. Seller reserves the right to cancel all such orders without information and explanation to anyone. 

         

        D. Description of Goods

        1.Goods includes product/items which are displayed on the seller’s website for selling.

        2,Seller has made every effort to display as accurately as possible the colors of products that appear on scalearts.in However, due to different color spectrum emitted by different output sources (i.e.) Mobile Phone, CRT monitors, TFT Panel screens, LED panel screens etc. the buyer who intends to purchase the product may see different color shades while ordering the product. The seller does not take responsibility and guarantee that any color will accurately reflect the color of the product on delivery. To the extent permitted by applicable law, seller disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on scalearts.in.

        3.In rarest of the rare instance, an item if may become unavailable prior to buyers checking out, buyer will be notified that the item is no longer available during the checkout process. All items are subject to availability. If during processing seller discover for any unforeseen reason cannot complete the order, seller has the exclusive right to cancel the order and an official email explaining the reason will be sent to the buyer (for instance, a stock shortage, inability to obtain payment, a product, or product description fault etc.) The seller will not supply substitute products without obtaining the consent of the buyer.

         

          E. Packaging Guarantee Notice:

          1.While seller makes every effort to ensure the safe delivery of the products, seller do not guarantee the condition of the outer packaging or acrylic cases, unless explicitly specified for carded models or mentioned otherwise. Despite best efforts in packaging, damages may occur in transit. The seller strives to pack products securely to minimize the risk of damage during shipping. However, the outer packaging and acrylic cases are subject to the handling of the shipping process and seller takes no responsibility for the damage caused to the outer packing due to shipping process. Any scratches on the acrylic cases may occur during packaging, handling, or logistics. We regret that we cannot accept return or replacement requests for such issues. Thank you for your understanding.

          2.Seller is not liable and is not responsible for any poor quality product delivered and does not accept the return requests regarding the product poor build quality of the product as seller is not the manufacturer of the goods and products. Seller is the supplier of the goods through the selling portal scalearts.in.

          3.The catalog displays available on the portal bluecor.in, the seller does not manufacture it but imports it from the manufacturer from different countries or source it from the official supplier for selling purpose.  These are different class of product which are generally not found locally and it is assumed that those buyers who orders them are already pre-qualified with the basic knowledge of the product hence seller does not accept return for quality issues on these models. Most of the models do not have free-moving wheels, queries related to the same will not be entertained and will not be qualified for return. The seller will not accept a return for this reason.

          4.Since the category does not come under Toys (unless mentioned otherwise) and is specifically mentioned as collectibles, these does not have any play value. The meaning of the term collectibles is self-explanatory. collectibles are replica of live models of different objects in compact scaled form with all details as of original objects. Hence seller will not accept any return request regarding complaint of parts not moving etc. Larger portion of the models has Press Fit wheels assembly, if in any case any part is out of original position, pressing the parts back and locating it to the original place will solve the problem and hence no return or replacement request in such cases will be entertained.

           

            F. Shipping

            1.All delivery charges are to be paid by the buyer as shown in the product description page, if it shows “Free shipping” no charge will be incurred for the shipping. Delivery will be made at the address specified at the time of ordering. After confirming the order, the delivery may take 7 to 28 days to deliver the goods depending upon the location and availability of the delivery partner. Still the seller will make every effort to deliver within the times specified and shall use best endeavors to deliver the Goods within 7-12 working days from the confirmation of order. All times or dates given for delivery of the Goods are only estimates given in good faith and are not conditions or warranties of contract.
            If any goods are required on a specific date it is recommended to ordered the goods well in advance to avoid any disappointment. Delivery charges vary depending on the type of products ordered and the service available for specific area.
            At the time the Goods are delivered to the address mentioned, the risk in the Goods shall pass to buyer and buyer shall be solely responsible for the custody and maintenance thereof.


              G. International Shipping

              1.The Jurisdiction of the seller to ship worldwide is not limited and restricted to one place and can ship the product worldwide, hence for international shipping interested buyer can enquire about product on “bluecorindia@gmail.com” and buyer can get reply within 24-48 hours.

                 For international order seller only accepts “PayPal” payment platform.


                H. Pre-Order Policy

                1. Approximate Timeframe:

                The time provided in the pre-order listing is approximate and subject to change. Delays may occur due to production, shipping, or other unforeseen circumstances, act of god etc. We will do our best to keep you informed of any changes to the estimated time-frame.

                2. No Cancellation Policy:

                It is assumed that buyer have reviewed all product details before confirming order. Hence once a pre-order is placed, it cannot be canceled.


                3. No Refund Policy:

                By placing a pre-order, buyer acknowledge and accept that the purchase is final hence seller is not bound to refunds for pre-orders under any circumstances.


                4. Price Adjustment Rights:

                Scale Arts In. reserves the right to change prices for pre-order items. In the event of a price change, the new price will apply to all pre-orders, regardless of when they were placed.


                5. Order Cancellation by Seller.:

                Bluecor.in  reserve the right to cancel pre-orders for various reasons, including but not limited to insufficient stock, unforeseen production issues, or discontinuation of the product. In such cases full refund will be processed.


                6. Dispute Resolution:

                Bluecor.in reserves the exclusive right to resolve any pre-order issues through official communication channels.

                7. Legal Action Against Threats or Defamatory Statements:

                a. Any threats, including statements of intent to post on social media platform or any defamatory statements made against Bluecor.in its products, or its reputation will be considered a serious violation and damage to the image/repute of the company. Appropriate Legal action may be initiated to protect our brand image and business. Any matter relating thereto shall be subject only to jurisdiction of the Courts at Pune, India and shall be interpreted as per the terms of the law /s for the time being in force in India.

                b. Any inappropriate behavior, using foul language while official communicating with authorized staffs of Bluecor, will not be tolerated in any form and will be liable for automatic rejection of complaint.

                 c. By placing a pre-order with Bluecor. through authorized web store, WhatsApp channel, Telegram channel, Instagram Channel, email or communicated to any official social media channel belonging to Bluecor. (We do not take any responsibility for the order placed with any drop shipping vendor or with any individual outside Bluecor.in staff) you acknowledge and agree to abide by the terms outlined in this policy.                 When an order is placed with Bluecor.in , you are also interacting with payment gateway companies and third-party logistics companies. Each company has its own set of rules, guidelines, and timeframes. So any disputes or issues related to the order will need the stipulated time to be resolved.

                All disputes shall be subject only to jurisdiction of the Courts at Pune, India and shall be interpreted as per the terms of the law /s for the time being in force in India.
